Does bankruptcy stop foreclosure in New York?

Yes. Filing bankruptcy triggers an automatic stay that immediately halts a foreclosure, including a scheduled auction. The stay is a pause, not a resolution — what happens after it depends on which chapter you file and whether the underlying mortgage problem gets fixed.

What the automatic stay does

The moment a bankruptcy petition is filed, federal law imposes an automatic stay on collection activity. A foreclosure sale scheduled for the next morning cannot proceed. This is why bankruptcy is sometimes filed as an emergency measure days before an auction — it buys time when nothing else will.

What it does not do

The stay does not cancel the mortgage, erase the arrears, or make the lender go away. A secured lender can ask the bankruptcy court to lift the stay, and if the underlying default is never cured, the foreclosure resumes where it left off.

Chapter 13 versus Chapter 7

Chapter 13 is the chapter that can actually save a home: it allows the arrears to be repaid over a three-to-five-year plan while regular monthly payments resume. Chapter 7 discharges unsecured debt but does not provide a mechanism to cure a mortgage default, so the stay typically delays the foreclosure rather than resolving it.

When foreclosure defense is the better tool

In many New York cases the home can be protected without a bankruptcy on your record. Foreclosure here is a judicial process: the case is contested in court while a loan modification is negotiated at the court-mandated settlement conference. If the modification lands, the arrears are capitalized, the payment becomes affordable, and the foreclosure ends without a bankruptcy filing.

How to think about the choice

Bankruptcy is strongest where the problem is broad — multiple creditors, judgments, unmanageable unsecured debt alongside the mortgage. Foreclosure defense is strongest where the problem is the mortgage itself and the household income can support a modified payment. Some situations call for both, in sequence.
